Investigation

The no investigation

After the arrest and incarceration of D. Bean and the additional person involved in the shooting, the so called investigation began. The additional person opted to both cooperate and plead guilty to attempted murder of the CI and their friend. He was questioned as to whether he knew Joseph or heard his name, to which he gave statements on numerous occasions that he did not know him or of him in any way nor had he ever seen or talked to him.

D. Bean was questioned multiple times and sadly, he gave mutiple stories. In one story he said that he was hired by his cousin, he said he received the gun for the shooting from his cousin, he received the gun from the additional person, and so on. During his second or third statement to the police, and after receiving their theory of the crime he said that he was hired by Joseph. Unfortunately, he could not decide how much he was paid, when he was, or where he was paid, but, that didn't matter to the police at all. He was also never given a polygraph to determine his truthfulness despite giving many statements and his uncertainty of crucial facts.

With D. Beans statement and only his statement the police then opted to arrest and charge Joseph and move him forward in the prosecution of this crime. Sadly, our county does not have an integrity unit or department to review evidence of a case before prosecuting a person. The police also handed what they believed to be the facts of the case to another detective on staff and asked him to review dates that D. Bean gave to see if he and Joseph were anywhere near one another on any of those dates.

Despite being one of the wealthiest County's in the Country, rather than hire a cell phone expert, they used the services of this detective. Armed with names, dates, a theory, and a few classes he narrowed down 2 different days in which D. Bean and Joseph could have possible been in the same area at the same time. Although Joseph is a native of Montgomery county, they did not consider he was in the county on those days at home, his fathers, seeing his children, visiting friends, dining, shopping, or for any other reason but to meet D. Bean at some point. At the end of the Detective/Cell Phone Analyzer's review, he was still unable to pinpoint Joseph exactly with D. Bean, however, he was able to put the additional person directly with D. Bean.

Yet, they moved forward with the case, even though they had never investigated anyone else including but not limited to D. Bean's cousin he mentioned twice. Mentioned him as the person who provided the gun, and the person who hired him, although, he only mentioned the cousin by name in his statement of receiving the gun from said cousin.

Now, it is also important to mention that the police also never asked Joseph where he was able to obtain illegal guns to sell to the CI. I think that is an important fact because, what if that uninvestigated person ordered the hit, especially if that person was D. Bean's cousin and also the exact person the detective/cell reporter was able to definitively place with D. Bean on the days of interest and yet he was never charged or even investigated!
